Landlord and Tenant Duties in San Diego Mold Inspection and Removal


"Although tenants are responsible for the maintenance of their respective units, landlords must also respond to specific problems. In Green v. Superior Court (1974), it was held that all rental agreements must come with an implied warranty of habitability. In other words, the landlord has to deal with problems, e.g. mold, which affect the property’s habitability. If mold was already present even before a tenant moves into the unit in question, the task of removing it falls to the landlord. The presence of mold, after all, is considered a defect in the structure that violates local health and building codes. Sometimes, mold can be the tenant’s responsibility if it arises from damage of his or her own doing. At any rate, it would be wise to undertake thorough mold inspection in San Diego as soon as signs of infestation become apparent."
